02Purpose and acceptance
These terms and conditions govern access to and use of the criatima.pt website, in its Portuguese, French and English versions. The website presents Criatima and its digital agency services — brand identity, websites, online shops, apps, SEO, Google Ads, social media and content — and allows users to request quotes and contact the company. By using the website, users confirm that they have read and accept these terms. If you do not agree with them, you should not use the website.
03Use of the website
Users undertake to use the website lawfully, in good faith and in accordance with these terms. In particular, it is not permitted to: introduce viruses or any other malicious code; attempt to gain unauthorised access to systems, servers or data; overload or disrupt the operation of the website, including through automated content collection (scraping) or bulk requests that harm the service; submit false, unlawful or offensive content, or unsolicited advertising, through the forms; or use third-party data without being entitled to do so. Criatima may block access for anyone who breaches these rules.
04Intellectual property
The texts, the Criatima brand and logo, the design, the code, the photographs, the videos and the other content of the website are protected by the Portuguese Code of Copyright and Related Rights (Código do Direito de Autor e dos Direitos Conexos, approved by Decree-Law no. 63/85 of 14 March) and by industrial property law, and belong to Criatima or to their respective owners. Project images shown in the portfolio belong to the respective clients or to Criatima, and client brands are the property of their owners. Reproducing, distributing, modifying or commercially using this content without prior written permission is prohibited, except where expressly permitted by law.
05Prices and quote requests
Prices shown on the website, preceded by “from”, are reference prices excluding VAT (IVA), which is added at the applicable statutory rate. They do not constitute a contractual offer: the final price depends on the scope, complexity and timescales of each project. Sending a quote request or a message through the website does not constitute a contract and creates no obligation to enter into one, either for the user or for Criatima.
06Proposals and contracts
Each service is provided on the basis of a written proposal and a specific contract, which set out the scope, price, timescales, payment terms and other applicable conditions. In the event of any discrepancy between the information on the website and the proposal or contract accepted by the parties, the proposal and the contract prevail. Where the client is a consumer, the mandatory statutory consumer protection rules also apply.
07Links to third-party websites
The website may contain links to third-party websites, such as those of clients, partners or social networks, and may embed external services such as Google Maps. These links are provided solely for the user’s convenience. Criatima does not control those websites and is not responsible for their content, availability or privacy policies, which users should consult.
08Liability
Criatima makes every effort to keep the website available and its information accurate and up to date, but does not guarantee that the website will operate without interruption or error, or that it will be free from technical faults beyond its control. To the extent permitted by law, Criatima is not liable for damage resulting from interruptions, unavailability or errors of the website, from acts of third parties or from the content of third-party websites. This limitation does not apply to damage caused by wilful misconduct or gross negligence on the part of Criatima, nor does it affect the rights granted to consumers by law.
09Personal data and cookies
Personal data submitted through the website is processed in accordance with the General Data Protection Regulation (Regulation (EU) 2016/679) and Portuguese Law no. 58/2019 of 8 August, as described in the Privacy policy. The use of cookies and similar technologies is described in the Cookie policy. Both documents are available in the footer of every page of the website.
10Changes to these terms
Criatima may change these terms at any time, in particular to reflect legal, technical or service changes. The version in force is the one published on this page, with the date of the last update shown at the top. Changes do not affect contracts already concluded, which remain governed by the agreed conditions.
11Complaints book
Under Portuguese Decree-Law no. 156/2005 of 15 September, users may file a complaint in the Electronic Complaints Book (Livro de Reclamações Eletrónico) at www.livroreclamacoes.pt, which can also be reached through the link in the website footer. Any complaint or suggestion may also be sent directly to [email protected].
12Alternative dispute resolution
In the event of a consumer dispute, consumers may refer it to an alternative dispute resolution body under Portuguese Law no. 144/2015 of 8 September, namely CNIACC — Centro Nacional de Informação e Arbitragem de Conflitos de Consumo, the Portuguese National Centre for Consumer Dispute Information and Arbitration (www.cniacc.pt). Further information on consumer alternative dispute resolution bodies is available on the Portal do Consumidor (www.consumidor.gov.pt).
13Governing law and jurisdiction
These terms are governed by Portuguese law. Any dispute relating to the website or to these terms falls within the jurisdiction of the courts of the judicial district (comarca) of Santarém, Portugal, without prejudice to applicable mandatory legal rules. In particular, consumers may bring proceedings before the courts of their place of residence, as provided by law.
14Language versions
These terms are available in Portuguese, French and English. In the event of any discrepancy between the versions, the Portuguese version prevails.
